Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 24, 1999.
G.R. No. 120421 (Universal Testile Mills, Inc. petitioner, vs. National Labor Relations Commission, et al.)
It appearing that Atty. Sebastian Abrenica, counsel for private respondent, failed up to this very late date to comply with the resolution of July 9, 1997 which required him to furnish this Court with the correct address of private respondent Ariel Borja, despite the resolutions of July 8, 1998 imposing on him a fine of P1,000.00 or five days imprisonment in case of non-payment, and of November 9, 1998 increasing the said fine to P2,000.00 and ordering him to suffer ten days imprisonment if such fine is not paid for his continued failure to comply with the resolution of July 9, 1997, and it appearing further that this case still awaits the comment of private respondent Ariel Borja on the petition for certiorari, the Court, accordingly, DECLARES Atty. Sebastian Abrenica GUILTY of contempt under Rule 71, Section 3[b] of the 1997 Rules of Civil Procedure, and ORDERS his IMPRISONMENT until he complies with the aforesaid resolutions of November 9, 1998 and July 9, 1997. The Division Clerk of this Court is hereby directed to ISSUE the Order of Arrest and Commitment for immediate service by the National Bureau of Investigation."
NOW, THEREFORE, You are hereby COMMANDED to ARREST Atty. Sebastian Abrenica and to COMMIT him to your detention cell until he complies with the resolutions of November 9, 1998 and July 9, 1997, unless further detained for some other lawful cause, and to MAKE an immediate return of compliance therewith.
