Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 24, 1999.
G.R. No. 127591 (Eduardo Tuazon vs. National Labor Relations Commission, et al.)
The motion of the Solicitor General for an extension of thirty (30) days from December 17, 1998 within which to file memorandum for the National Labor Relations Commission is GRANTED. The aforesaid memorandum of the National Labor Relations Commission and of petitioner, the manifestation of petitioner dated November 27, 1998, remitting the deposit for costs and clerk's commission in the amount of P500.00 under O.R. 9503732 dated December 2, 1998, and the manifestation of private respondent Philippine Postal Savings Bank, Inc. dated December 16, 1998, stating that it is adopting the memorandum of the Solicitor General as its own memorandum are all NOTED.
Consistent with the pronouncement of this Court in St. Martin Funeral Home vs. National Labor Relations Commission, et al., G.R. No. 130866, September 16, 1998, that all references in the amended Section 9 of B.P. No. 129 to supposed appeals from the National Labor Relations Commission to the Supreme Court are inherited to mean and refer to petitions for certiorari under Rule 65 of the Rules of Court, and that consequently, all such petitions should henceforth be initially filed in the Court of Appeals in strict observance of the doctrine on the hierarchy of courts as the appropriate forum for the relief desired, the Court RESOLVES to REFER this case to the Court of Appeals for appropriate action and disposition.
