Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 16, 1999.

G.R. 130775 (The National Liga Ng Mga Barangay, etc., et al. vs. Hon. Victoria Isabel A. Paredes, etc., et al.). and G.R. 131939 (Leandro Yangot, et al. vs. Department of Interior and Local Government Secretary, et al.)

Acting on the Notice of Death of Petitioners' Representative and Motion for Substitution filed by counsel for petitioners in G.R. No. 130775, dated January 15, 1999, giving notice to the Court of the death of Hon. Alex David, the Court Resolved to GRANT the aforesaid motion for substitution.

The Court further Resolved to consider MOOT, in view of the grant of the motion for substitution, the Manifestation with Motion filed by counsel for respondent Manuel A. Rayos, dated January 18, 1999, stating, among others, that pursuant to Section 17, Rule 3 of the Rules of Court, this case should be dismissed, it appearing that no successor of petitioner has taken his oath of office and it is not satisfactorily shown that there is a substantial need for continuing or maintaining it.

It appearing that the resolutions of October 13 and 20, 1998, both addressed to Atty. Marciano J. Cagatan, collaborating counsel for petitioners, Suite 18 FEMII Bldg. Annex, Aduana Street, Intramuros, Manila were returned unserved with their respective notations on the letter-envelopes "unclaimed," the Court Resolved to CONSIDER as SERVED the aforesaid resolutions."
