Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 1, 1999.

G.R. No. 133960 (Jovito dela Cruz vs. People of the Philippines.)

The motions of the Solicitor General for second and third extensions of time totalling sixty (60) days from October 27, 1998 within which to file his comment on the petition for review on certiorari are GRANTED.

Considering the allegations, issues and arguments adduced in the petition for review on certiorari as well as the comment thereon of the Solicitor General, the Court RESOLVES to DENY the petition, the issues raised being essentially factual and there being no sufficient showing that the findings of the respondent court are not supported by the requisite quantum of evidence or that said court had committed any reversible error in the questioned judgment.
