Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 24, 1999.

G.R. No. 135479 (Aizer Bruns Corporation vs. National Labor Relations Commission, et al.)

The urgent motion of petitioner praying that the resolution of November 11, 1998 set aside and that the case be referred to the Court of Appeals in line with the ruling in St. Martin Funeral Home vs. National Labor relations Commission, et al. is DENIED for lack of merit.

Acting on the motion of petitioner for reconsideration of the resolution of January 13, 1999 which denied with finality the resolution of November 11, 1998 dismissing the petition for certiorari, the Court RESOLVES to TREAT the motion as a second motion for reconsideration of the aforesaid resolution of November 11, 1998 and to DENY the same pursuant to Section 2, Rule 52, in relation to Section 2, Rule 56 of the 1997 Rules of Civil Procedure as amended. The opposition of private respondents to the aforesaid motion and the withdrawal of Atty. Anthony T. Zamora as counsel for petitioner with the conformity of petitioner's representative are NOTED.
