Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 1, 1999.

G.R. No. 135783 (In the matter of the petition for the issuance of the writ of habeas corpus of Hirofumi Toshimitsu: Cresencio S. Avila, Jr. vs. Members of the Special Operations Group of the Southern Police District command (SOUTHCOM), et al.)

Acting on the motion of petitioner for reconsideration of the resolution of November 16, 1998 which denied the petition for writ of habeas corpus, the Court RESOLVES to DENY the same with FINALITY, the basic issues raised therein having previously been duly considered and passed upon by the Court in the aforesaid resolution and no substantial argument or compelling reason having been adduced to warrant the reconsideration sought.

The manifestation of petitioner dated January 2, 1999 stating that he had mailed to the Court the Original copy of the aforesaid motion for reconsideration of the resolution of November 16, 1998 and submitting copies thereof is NOTED.
