Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 3, 1999.

G.R. No. 135891 (National Power Corporation vs. J. Ancheta Merchandising, Inc.)

Acting on petition for review on certiorari, the Court RESOLVES to DENY the same, pursuant to Sections 4(b) and 5, Rule 45 in relation to Section 5(d), Rule 56 of the 1997 Rules of Civil Procedure as amended, petitioner having failed to submit a verified statement of the date of filing of its motion for reconsideration of the assailed decision of the Court of Appeals; and, to Section 2, Rule 45 in relation to Section 5(a), Rule 56 the petition having been filed late on December 1, 1998, i.e, beyond the fifteen-day reglementary period. Accordingly, respondent's comment on the aforesaid petition is NOTED WITHOUT ACTION.
