Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 1, 1999.

G.R. No. 135939 (Henry Ramos and Yasser A. Abbas vs. U.P. Student Disciplinary Tribunal and Dan Magat.)

Acting on the petition for review on certiorari dated November 21, 1998, the Court RESOLVES to DENY the same pursuant to Section 5 (a) and (d), Rule 56 of the 1997 Rules of Civil Procedure, petitioners having failed to take the appeal within the reglementary period provided in Section 2, Rule 45, in view of he denial of their motion for extension of time to file the petition in the resolution of December 2, 1998, and to Sections 3 and 5, Rule 45, Section 5(d), Rule 56, and Section 13, Rule 13, as well as Sections 4(b) and 5, Rule 45 of the same Rules, as they likewise failed to submit a duly accomplished affidavit of service of copies of the petition on the respondents clearly indicating the place of such service by mail, as well as to submit a verified statement of the date of filing of their motion for reconsideration of the assailed decision before the Court of Appeals.
