Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same pursuant to Section 13, Rule 13 in relation to Section 3 and 5, Rule 45 and Section 5 (d), Rule 56 of the 1997 Rules of Civil procedure, the affidavit of service of copies of the petition on the respondent being unsigned and ineffectual since the same was subscribed and sworn to on December 9, 1998 but service of copies of the petition on respondent and the Court of Appeals was done on December 10, 1998.
