Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 17, 1999.

G.R. No. 136064 (Sangguniang Manggagawa sa TFC vs. Department of Labor and Employment, et al.)

Acting on the manifestation and motion of the Solicitor General stating that pursuant to Section 5, Rule 65 of the 1997 Rules of Civil Procedure, private respondent, who stands to benefit from the impugned decision of public respondent, should take the cudgels for the latter, and praying that he be reviewed from filing the required comment on the petition for certiorari, the Court RESOLVES to DENY the same and to REQUIRE the Solicitor General to COMMENT on the petition within ten (10) days from notice hereof.

The Court further resolves to : (a) GRANT the motion of private respondent for an extension of thirty (30) days from January 18, 1999 within which to file comment on the petition for certiorari and the manifestation and motion of the Solicitor General to be relieved from filing comment on the aforesaid motion of petition for the issuance of a temporary restraining order; (b) NOTE WITHOUT ACTION petitioner's aforesaid urgent motion for the issuance of a temporary restraining order to restrain the certification election set by the public respondent on February 1, 1999, the subject of the said motion having become moot and academic; and (c) NOTE the comment of private respondent on the aforesaid motion of petitioner
