Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 8, 1999.

G.R. No. 136074-75 (ABS-CBN Broadcasting Corporation vs. Confield Construction and Development Corporation.)

Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same pursuant to Sections 4(b) and (d), and 5, Rule 45 in relation to Section 5 (d), Rule 56 of the 1997 Rules of Civil Procedure, petitioner having failed to submit the duplicate original or certified true copies of the questioned decision and resolution f the Court of Appeals, and a verified statement of the date of filing of its motion for reconsideration of the questioned decision of the Court of Appeals.

Accordingly, petitioner's urgent motion dated January 18, 1999 for the issuance of a temporary restraining order and Preliminary injunction is NOTED WITHOUT ACTION.
