Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 8, 1999.

G.R. No. 136107 (Pedro Torres, et al. vs. Laureano Carbonel, et al.)

Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same, petitioner having failed to take the appeal within the reglementary period fixed in Section 2, Rule 45 in relation to Section 5 (a), Rule 56 of the 1997 Rules of Civil Procedure in view of the denial of their motion for extension of time to file the petition for failure to submit an affidavit of service of copies of the motion on the respondents; and failed likewise to submit a certification against forum shopping, duly executed by themselves in accordance with Section 4 (e), Rule 45 in relation to Section 5, Rule 7, Sections 4 and 5(d), Rule 56 and the second paragraph of Section 2, Rule 42 of said Rules of Civil Procedure.
