Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 22, 1999.

G.R. No. 136230 (Consolacion L. Estaris, et al. vs. Hon. Percival Mandap Lopez, Regional Trial Court, Branch 78, Quezon City, et al.)

Acting on the petition for certiorari with prayer for preliminary injunction and/or restraining order, the Court RESOLVES to DISMISS the same for petitioners' failure to submit the duplicate original or certified true copy of the questioned order of respondent judge dated February 17, 1998 in accordance with Section 1, Rule 65 and Section 3, Rule 46 in relation to Section 2, Rule 56 of the 1997 Rules of Civil Procedure as amended.

Accordingly, the urgent motion of petitioners dated December 28, 1998 for the issuance of a temporary restraining order is NOTED WITHOUT ACTION.
