Quoted hereunder, for your information, is a resolution of this Court dated FEB 8, 1999.
G.R. No. 136355 (Equatorial Realty Development, Inc. vs. Hon. Jose R. Hernandez of the Pasig Regional Trial Court, Branch 158, et al.)
Acting on the petition for certiorari and prohibition with prayer for preliminary injunction and/or restraining order, the Court RESOLVES to DISMISS the same for failure to adduce any compelling reason to warrant petitioner's disregard of judicial hierarchy in accordance with Rule 65, Section 4 of the 1997 Rules of Civil Procedure and for this Court to assume jurisdiction over the case in the first instance; besides, the petition is insufficient in form for lack of proper verification in accordance with Section 1, Rule 65 on relation to Section 4, Rule 7 and, accordingly the petition is treated as an unsigned pleading which, under Section 3, Rule 7, produces no legal effect.
Accordingly, petitioner's manifestation dated December 21, 1998 submitting to this Court the attached order of respondent judge dated November 26, 1998, with request for corrections of typographical errors and inadvertent omissions committed in the petition is NOTED WITHOUT ACTION.
