Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 22, 1999.
G.R. No. 136363 (Jose C. Vallejo vs. People of the Philippines.)
The motion of petitioner for an extension of thirty (30) days from November 21, 1998 within which to file petition for review on certiorari , is DENIED for failure to submit an affidavit of service by registered mail of copies of the motion on respondent and on the Court of Appeals and a written explanation for such non-personal service as well as for failure to pay the amount of P10.00 as balance of the deposit for costs, pursuant to Sections 11 and 13, Rule 13 and Sections 1, 3 and 5, Rule 45 and Section 5 (d), Rule 56 of the 1997 Rules of Civil Procedure as amended.
Accordingly, the petition for review on certiorari thereafter filed is DENIED for:
(a)������� failure to take the appeal within the reglementary period of fifteen (15) days in accordance with Section 2, Rule 45 in relation to Section 5 (a), Rule 56; and
(b)������� failure to submit with the petition a clearly legible duplicate original or a certified true copy of the questioned decision of the Court of Appeals pursuant to Sections 4 (d) and 5, Rule 45 in relation to Section 5 (d), Rule 56.
