G.R. No. 136399 (ESA Protective and Security Agency, Inc. vs. Rogelio Dimarucot, et al.)

Acting on the petition for certiorari, the Court RESOLVES to DISMISS the same pursuant to Section 2 (c), Rule 56, and the third paragraph of Section 3, Rule 46 in relation to the first paragraph of Section 2, Rule 56 and to Section 4, Rule 65 in relation to the second paragraph of Section 3, Rule 46, of the 1997 Rules of Civil Procedure, petitioner having failed to submit not only a verified statement of the dates of receipt of the assailed decision and of the filling of its motion for reconsideration of the assailed decision but also an affidavit of service of copies of the petition on respondent.
