Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 15, 1999.
G.R. No. 136405 (Teresita Viterbo and Ely Lorenzo vs. Department of Agrarian Reform Adjudication Board [DARAB], et al.)
The motion of petitioners for an extension of thirty (30) days from December 12, 1998 within which to file a petition for review on certiorari is GRANTED, PROVIDED THAT THIS IS THE LAST EXTENSION, counted from the expiration of the reglementary period and conditioned upon the timeliness of the filing of the said motion and the compliance with the requisites for its filing. Accordingly, petitioners' second motion for an extension of five (5) days until January 16, 1999 within which to file said petition is DENIED.
Acting on the aforesaid petition for review on certiorari, the Court RESOLVES to DENY the same pursuant to Section 5(a) and (d), Rule 56 in relation to Sections 2 and 3, Rule 45 of the 1997 Rules of Civil Procedure, petitioners having failed to take the appeal within the extended period granted above and to serve a copy of the petition on the Court of Appeals in accordance with Section 4, Rule 13 of the aforesaid Rules.
