Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same for failure to submit a written explanation for the non-personal service of a copy of the petition on respondent pursuant to Section 11, Rule 13 in relation to Sections 3 and 5, Rule 45 and Section 5 (d), Rule 56 of the 1997 Rules of Civil Procedure as amended.

Accordingly, the comment of respondent on the aforesaid petition for review on certiorari is NOTED.
