Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 17, 1999.

G.R. No. 136498 (Yolly Ornillo-Nolanda, joined by her husband, Jose Bernabe Nolanda, et al. vs. Crisanta Francisco, et al.)

The motion of petitioners for an extension of thirty (30) days from December 23, 1998 within which to file petition for review on certiorari is DENIED for their failure to submit an affidavit of service of a copy of said motion on the Court of Appeals in accordance with Section 13, Rule 13 in relation to Section 2, Rule 45 of the 1997 Rules of Civil Procedure. Accordingly, petitioners' motion for a second extension of thirty (30) days from January 23, 1999 within which to file the petition is NOTED WITHOUT ACTION.

Petitioners are INFORMED that they may claim the amount of P10.00 as excess payment of the prescribed legal fees under O.R. No. 9503942 dated December 28, 1998.
