[ G.R. No. 136958. February 3, 1999]
MACARTHUR R. SEJALBO, et al. vs. JOSE CATRAL MENDOZA, et al.
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 3, 1999.
G.R. No. 136958 (Macarthur R. Sejalbo, et al. vs. Hon. Jose Catral Mendoza, et al.)
Acting on the petition for certiorari, the Court RESOLVES to DISMISS the same, petitioners having failed to adduce any compelling reason to warrant their disregard of judicial hierarchy in accordance with Rule 65, Section 4 of the 1997 Rules of Civil Procedure and for this Court to assume jurisdiction over the case in the first instance.
The amended manifestation of petitioners stating the dates of filing of their motion for reconsideration of the order discharging Gerald Inguillo as state witness and of the denial of the said motion, which were inadvertently omitted in the aforesaid petition, and praying that the instant manifestation be made part of the petition is NOTED and GRANTED.
Very truly yours,
TOMASITA B. MAGAY-DRIS
Clerk of Court
