Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 25, 1999.
G.R. No. 110681 (People of the Philippines vs. Cynthia Alcantara De Guzman.)
From the records on hand, it appears that on March 6, 1998, there was received from accused-appellant a letter asking the Court if she can withdraw her present appeal so that she can apply for pardon or parole before the Board of Pardons and Parole.
On June 22, 1998, the Court resolved to inform appellant that the Court allows the "withdrawal voluntarily filed by accused-appellants of appeals pending before the Court". However, despite the lapse of more than six (6) months since then, accused-appellant has not been heard from.
WHEREFORE, the accused-appellant is hereby given five (5) days to send in her motion for withdrawal of the appeal; otherwise, the appeal shall be considered ripe for decision.
