Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 13, 1999.

G.R. No. 122078 (Philippine Rabbit Bus Lines, Inc. vs. National Labor Relations Commission, et al.)

Acting on the motion of Atty. Fabian Gappi, counsel for private respondent, for reconsideration of the resolution of September 9, 1998, which denied his motion to be executed from filing the comment on the petition for certiorari and required him to file the said comment within a non-extendible period of ten (10) days from notice, and to withdraw as presumed counsel of private respondent, the Court RESOLVED to DISPENSE with the filing of the aforesaid comment on the petition for certiorari and to IMPOSE upon Atty. Gappi a fine of P3,000.00 for his repeated failure to file the aforesaid comment as required in the resolution of October 23, 1995, payable to this Ocurt within ten (10) days from notice hereof.

Considering the allegations, issues and arguments adduced in the petition for certiorari as well as the comment thereon of the Solicitor General, the Court further RESOLVED: (a) to GIVE DUE COURSE to the petition; and (b) to consider the case SUBMITTED for decision.
