Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 18, 1999.
G.R. No. 126022 (People of the Philippines vs. Raul Cantuba and Romeo Balatucan.)
Considering the letter of Provincial Warden William A. Almi�ama, Masbate, Masbate dated November 12, 1998, by way of compliance with the resolution of September 30, 1998 which increased to P2,000.00 the fine imposed in the resolution of March 23, 1998 upon the Provincial Jail Warden of Masbate for failure to commit the accused-appellants to the New Bilibid Prison, with explanation for such failure, and information that accused-appellant Raul Cantuba had escaped from his detention cell on October 25, 1997 while accused-appellant Romeo Balatucan was committed to the Bureau of Corrections, Camp Sampaguita, Muntinlupa City on April 27, 1998, the Court RESOLVES to (a) NOTE the explanation; (b) LIFT the imposition upon the Provincial Warden of Masbate, Masbate of the aforesaid increased fine of P2,000.00 and/or imprisonment of ten (10) days; (c) DISMISS the appeal as to accused-appellant Raul Cantuba pursuant to Rule 124, Section 8 of the Rules of Court; (d) require the Presiding Judge of the Regional Trial Court of Masbate, Masbate, Branch 48 to ORDER the ARREST of accused-appellant Raul Cantuba for service of his sentence; and (e) require accused-appellant Romeo Balatucan to COMPLY with the letter dated September 4, 1997 of this Court and INFORM the Court of the name and address of his counsel who will represent him in this appeal, within ten (10) days from notice hereof.
