ARGUS CREDIT CORPORATION et al. vs. NLRC, et al.

SECOND DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 13, 1999.

G.R. No. 127518 (Argus Credit Corporation et al. vs. National Labor Relations Commission, et al.)

Considering the motion of the petitioners for reconsideration of the resolution of November 11, 1998 which dismissed the petition for certiorari for their failure to file the petitioner's consolidated reply to the separate comments of the public and private respondents on the petition for certiorari as required in the resolution of March 16, 1998 as well as their manifestation dated September 31, 1998 stating that they are no longer submitting the aforesaid consolidated reply since there were no new issues raised in the public and private respondents' comments on the petition, the Court RESOLVED: (a) to GRANT the motion for reconsideration; (b) to REINSTATE the petition; and (c) to REQUIRE the petitioners to COMPLY with the resolution of March 16, 1998 by filing their CONSOLIDATED REPLY to the aforesaid separate comments of respondents on the petition within ten (10) days from notice hereof.

Consistent with the pronouncement of this Court in St. Martin Funeral Home vs. National Labor Relations Commission, et al., G.R. No. 130866, September 16, 1998, that all references in the amended Section 9 of B.P. No. 129 to supposed appeals from the National Labor Relations Commission to the Supreme Court are interpreted to mean and refer to petitions for certiorari under Rule 65 of the Rules of Court, and that consequently, all such petitions should henceforth be initially filed in the Court of Appeals in strict doctrine on the hierarchy of courts as the appropriate forum for the relief desired, the Court further RESOLVED to REFER this case to the Court of Appeals for appropriate action and disposition.
