G.R. No. 129409 (Heirs of Fausta Beltran vs. Hobart Dator, et al.)

Acting on the motion of petitioner for qualified reconsideration of the resolution of September 16, 1998 which dismissed the petition for review on certiorari for non-compliance with the resolution of February 11, 1998 requiring them to file a reply to the Solicitor General's comment on the aforesaid petition, the Court RESOLVES to DENY the motion pursuant to Section 5 (d), Rule 56 of the 1997 Rules of Civil Procedure for lack of a written explanation for its non-personal service on respondents as required in Section 11, Rule 13 of the same Rules.
