Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 27, 1999.
G.R. No. 131915 (People of the Philippines vs. Ariel Rollon and Errol Rollon.)
Considering the pleadings filed in this case, the Court Resolved:
(a) to GRANT:
(1) the first motion of counsel for accused-appellants for extension of thirty (30) days from October 22, 1998 or until November 21, 1998 (not November 20, 1998) within which to file appellants brief; and
(2) the Solicitor General's motion for extension of thirty (30) days from December 25, 1998 or until January 24, 1998 within which to file appellee's brief; and
(b) to NOTE the appellants' brief dated November 18, 1998.
Considering the letter dated November 26, 1998, of Executive Judge Placido C. Marquez, Regional Trial Court, Romblon, informing the Court that accused-appellants were committed to the Romblon Provincial Jail for custody on December 1, 1997 but appellant Ariel Rollon died on September 2, 1998 per letter dated November 26, 1998 of the Provincial Warden and the death certificate attached thereto, while appellant Errol Rollon is awaiting transfer to the Bureau of Corrections when funds for the purpose is released, the Court Resolved:
(a) to DISMISS the appeal insofar as Ariel Rollon is concerned;
(b) to REQUIRE Judge Marquez to ORDER the commitment of accused-appellant Errol Rollon to the Bureau of Corrections, within ten (10) days from notice, and to SUBMIT a report to this Court of such commitment, within ten (10) days from notice; and
(c) to REQUIRE the Director of the Bureau of Corrections to CONFIRM to this Court the fact of appellant's commitment.
