Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 13, 1999.

G.R. No. 132948 (Levi Mateo y de Guzman vs. People of the Philippines.)

Pursuant to the En Banc resolution of April 7, 1988 reiterating its "Resolution Adopting Policy and Procedural Guidelines for the Supreme Court in the Implementation of Section 12, Article XVIII of the 1987 Constitution" that no motion for leave to file a second motion for reconsideration shall be entertained and Section 2, Rule 52, of the 1997 Rules of Civil Procedure that no second motion for reconsideration of a judgment or final resolution by the same party shall be entertained, the Court Resolved:

(a) to DENY petitioner's motion for leave to file a second motion for reconsideration of the resolution of July 8, 1998 which denied the petition for review on certiorari; and

(b) to NOTE WITHOUT ACTION the aforesaid second motion for reconsideration.
