Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same pursuant to Section 5 (d), Rule 56 of the 1997 Rules of Civil Procedure, for petitioner' failure to submit a written explanation of the non-personal service of copies of the petition on respondents as required by Section 11, Rule 13, of the same Rules.

The comment of respondents on the aforesaid petition is NOTED.
