Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 25, 1999.
G.R. No. 134557 (Northern Star Agribusiness Corp., et al. vs. Court of Appeals, et al.)
Considering the allegations, issues and arguments adduced in the petition for certiorari, the private respondent's comment thereon and the petitioners' reply thereto as well as the manifestation and motion of the Solicitor General dated November 17, 1998 in lieu of comment on the petition for certiorari with prayer to be excused from filing said comment for respondents Court of Appeals and Judge Ricardo M. Molina pursuant to Section 5, Rule 65 of the 1997 Rules Civil Procedure, the Court RESOLVES to NOTE and GRANT the aforesaid manifestation and motion of the Solicitor General dated November 17, 1998, and to DISMISS the petition for certiorari for lack of merit.
Accordingly, the Court further RESOLVES to SET ASIDE the resolution of September 16, 1998 which required petitioners to post a bond for the issuance of a temporary restraining order/preliminary injunction in this case and to NOTE the compliance of petitioners dated December 3, 1998 submitting to this Court the attached documents in support of and in consideration of its application for temporary restraining order/preliminary injunction in this case.
