Quoted hereunder, for your information, is a resolution of this Court dated JAN 13, 1999.

G.R. No. 134748 (Jacinto Borja vs. Hon. Presiding Judge Agapito Hontanosas, Jr. of the Municipal Trial Court in Cities, branch 1, Tagbiliran City and Margarito Lim.)

Acting on the motion of the petitioner for reconsideration f the resolution of September 2, 1998 which dismissed the petition for certiorari for failure to submit an affidavit of service of copies of the petition on the public private respondents, the duplicate original or certified true copy of the assailed decision of the respondent court, and a verified statement of material dates and for being insufficient in form for lack of proper verification as well as for being violative of the private respondent's right against double jeopardy, the Court RESOLVED to DENY the same with FINALITY, no substantial argument having been adduced to warrant the reconsideration sought.
