Quoted hereunder, for your information, is a resolution of this Court dated JAN 13 1999.

G.R. No. 134782 (Rufina and Angel Libo-on, Jr. vs. Spouses Presentacion and Alfredo Guillergan.)

Acting on the motion of the petitioners for reconsideration of the resolution of October 19, 1998 which dismissed the petition for review on certiorari for failure to remit the deposit for the sheriff's fee and clerk commission and to serve a copy of the petition on the Court of Appeals, as well as to submit a written explanation for the non-personal service of copies of the petition on the respondents as required in Section 11, Rule 13 of the 1997 Rules of Civil Procedure, the Court RESOLVED to DENY the same with FINALITY, no compelling reason having been adduced to warrant the reconstitution sought.
