Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 13, 1999.
G.R. No. 134795 (Toyota Otis, Inc. vs. National Labor Relations Commission, et al.)
Considering the grounds of the petitioner's motion for reconsideration of the resolution of September 14, 1998 which dismissed the petition for certiorari, the Court Resolved:
(a) to GRANT the motion for reconsideration and to REINSTATE the petition; and
(b) to require the respondents to COMMENT on the petition, within ten (10) days from notice.
In case G.R. No. 130866, "St. Martin Funeral Homes vs. National Labor Relation Commission, et al.", promulgated on Sept 16, 1998, the Court En Banc declared that all appeals from the NLRC to the Supreme Court [petition for certiorari under Rule 65 of the 1997 Rules of Civil Procedure] should henceforth be initially filed in the Court of Appeals as the appropriate forum for the relief desired in strict observance of the doctrine on the hierarchy of courts.
ACCORDINGLY, the Court Resolved to REFER this case to the Court of Appeals for appropriate action and disposition.
