Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 13, 1999.

G.R. No. 134970 (Conrado Ragusta vs. Francisca Francisco.)

Acting on the motion of the petitioner for reconsideration of the resolution of September 28, 1998 denying his motion for an extension of time to file a petition for review on certiorari for failure to remit the amount of P500.00 as deposit for costs as well as the to submit the registry receipts as proof of mailing of copies of the motion to the respondent and to the Court of Appeals, the Court RESOLVED to DENY the same with FINALITY, no compelling reason having been adduced to warrant the reconsideration sought; besides the petition for review on certiorari has already been dismissed in the resolution of November 11, 1998.

The payment of the petitioner in the amount of P500.00 as deposit for costs under O.R. No. 9503547 dated October 16, 1998 is NOTED.
