Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 18, 1999.
G.R. No. 135515 (Republic of the Philippines vs. Ram Builders and Development Corporation.)
Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same for having been filed late on November 17, 1998, due date being October 18, 1998 in view of the denial of the petitioner's motions for extension of time to file the petition in the resolution of November 18, 1998; besides, the petition is insufficient in form for lack of proper verification pursuant to Section 4, Rule 7 of the 1997 Rules of Civil Procedure since affiant merely stated that "she is the counsel for the petitioner and that she caused the preparation of the said petition" and failed to attest to the truth and correctness of the allegations therein; accordingly, in view of this lack of a proper verification, the petition shall be treated as an unsigned pleading which under Section 3, Rule 7, produces no legal effect. Moreover, petitioner failed to comply with Section 13, Rule 13 in relation to Section 3, Rule 45 both of the aforesaid Rules of Civil Procedure since the affidavit of service of copies of the petition on the respondents failed to state the date of service and the registry receipt numbers as proof of such service.
