Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 18, 1999.

G.R. No. 135838 (Eufronio Delantar, et al. vs. Dulce Canada Delantar, et al.)

Acting on the petition for review on certiorari of the decision dated September 17, 1998 of the Court of Appeals, the Court Resolved to DENY the petition for having been posted late on November 6, 1998, as petitioners' motion for extension of thirty (30) days from the expiration of the reglementary period within which to file the petition was denied in the resolution of November 23, 1998 and the reglementary period within which to file the petition expired October 9, 1998, counsel for petitioners having received a copy of the assailed decision on September 24, 1998.

In any event, even if the petition was filed on time, it would still be denied, as the issues raised are factual and petitioners failed to show that a reversible error had been committed by the appellate court.
