G.R. No. 136169 (Alexander Loinaz vs. Court of Appeals, et al.)
Acting on the petition for certiorari, the Court Resolved to DISMISS the petition for been filed late. A petition for certiorari is not a substitute for a lost remedy of appeal under Rule 45 of the Rules of Court.
In any event, even if the petition was filed on time, it would still be dismissed as the petitioner failed to show that grave abuse of discretion had been committed by the public respondent.
