Quoted hereunder, for your information, is a resolution of this Court dated JAN 27, 1999.

G.R. No. 136243 (Zenaida Cascolan vs. Jaime Co.)

Acting on the petition for review on certiorari, the Court RESOLVES to DENY the same pursuant to Section 5, Rule 56 in relation to Section 3, Rule 45 of the 1997 Rules of Civil Procedure, petitioner having failed to comply with Section 13, Rule 13 of the same Rules governing proof of service since the affidavit of service of the petition on respondent failed to state the place of such service.

The petitioner is hereby INFORMED that she may claim the amount of P378.00 as excess payment of the prescribed legal fees under O.R. No. 9503698 dated December 1, 1998 within fifteen (15) days from notice hereof.
