Quoted hereunder, for your information, is a resolution of this Court dated JAN 18, 1999.

G.R. No. 136290 (Iwahori Philippines, Inc. vs. Court of Appeals, et al.)

Acting on the petition for certiorari dated November 25, 1998, the Court RESOLVES to DISMISS the same for being a wrong remedy, the proper recourse being a petition for review on certiorari under Rule 45 of the 1997 Rules of Civil Procedure; besides, the petition was filed out of time and the prescribed legal fees and deposit for costs paid late on December 3, 1998, due date of both being June 8, 1998; and moreover a copy of the petition was not served on private respondent union.
