Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 18, 1999.

G.R. No. 136295 (Provident Tree Farms, Inc. vs. The Hon. Secretary of the Department of Environment and Natural Resources.)

The motion of the petitioner for an extension of fifteen (15) days within which to file a petition for review on certiorari is DENIED, the affidavit of service of copies of the motion on the respondents being not in accord with Section 13, Rule 13, in relation to Rule 45, Section 2 of the 1997 Rules of Civil Procedure, since it failed to state the place of such service by registered mail.

Accordingly, the aforesaid petition for review on certiorari is DENIED for having been filed late on December 18, 1998; besides, the affidavit of service of copies of said petition on the respondents also failed to comply with Rule 13, Section 13 in relation to Rule 45, Section 3 of 1997 Rules of Civil Procedure since it likewise failed to state the place of such service by registered mail.
