G.R. No. 136346 (Eglantine G. Franco vs. Court of Appeals, et al.)

Acting on the petition for certiorari and prohibition, the Court RESOLVES to TREAT the petition as a petition for review on certiorari under Rule 45 of the 1997 Rules of Civil Procedure and DENY the same for petitioner's failure to serve a copy of the petition on the Office of the Solicitor General and to submit a verified statement of the date of filing of the motion for reconsideration of the assailed resolution of the Court of Appeals pursuant to Sections 3 and 4, Rule 45, in relation to Section 5 (d), Rule 56 of the same Rules.
