Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 27, 1999.
G.R. No. 136471 (Skills International Company, Inc. vs. National Labor Relations Commission, et al.)
Acting on the petition for certiorari, with prayer for a writ of preliminary injunctions and/or a temporary restraining order, of the decision dated July 6, 1998 of the National Labor Relations Commission in NLRC NCR CA No. 014661-98, the Court Resolved to DISMISS the petition for having been filed late on December 22, 1998, as the reglementary period within which to file the petition expired December 7, 1998, counsel for petitioner having received a copy of the resolution denying petitioner's motion for reconsideration of the assailed decision on October 6, 1998.
Besides, even if the petition was filed on time, it would still be dismissed for failure to comply with the requirements of the 1997 Rules of Civil Procedure, as it lacks affidavit of service of a copy thereof on the Solicitor General [Sec. 3, Rule 45]; and the certification against forum shopping [Sec. 5, Rule 7].
