Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 27, 1999.
G.R. No. 136823 (Asuncion Atienza, et al. vs. Hon. Conrado K. Antona, et al.)
Considering the pleadings filed in this case, the Court Resolved:
(a) to GRANT the motion of counsel for petitioners for extension of thirty (30) days from the expiration of the reglementary period within which to file a petition for review on certiorari, conditioned upon the timeliness of the filing of the same and the payment of the docket and legal research fund fees and compliance with the requirements of the 1997 Rules of Civil Procedure;
(b) to NOTE the ex-parte motion and manifestation dated January 12, 1999, filed by counsel for petitioner Rolly Enriquez, explaining why a copy of the motion for extension was served on the Court of Appeals by registered mail; and
(c) to DENY, for lack of merit, the very urgent motion to stay the order of demolition.
Acting on the petition for review on certiorari with prayer for a writ of preliminary injunction and/or a temporary restraining order, of the decision dated June 23, 1998 of the Court of Appeals in CA-G.R. SP No. 46408, the Court Resolved to DENY the petition for failure of the petitioners to show that a reversible error had been committed by the appellate court.
