Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 26, 1999.

A.M. No. 8443-Ret (Re: Application for Disability Retirement of Mr. Teofilo M. Mendez.)

Acting on the application for disability retirement filed by Mr. Teofilo M. Mendez, Interpreter, Regional Trial Court, Cebu City, under P.D. 1146, as amended by R.A. 8291, effective 14 October 1994, and it appearing that the applicant is: (1) over 62 years old, with more than 36 years service in government; (2) suffering from Cerebro-Vascular Accident, with Residual Right Hemipparesis, Secondary to Hypertensive Cardiovascular Disease; per memorandum dated 2 February 1995 of Dr. Rosa J. Mendoza, Director 1, concurred in by Dr. Cecilia C. Villegas, then Director 111, Chief, SC Clinic Services, that the applicant be retired under a permanent partial disability; and (3) the foregoing sickness incurred by Mr. Mendez shows that he did not satisfy the condition specified under Sec. 17, R.A. 8291, the Court Resolved to DENY the application for disability retirement of Mr. Teofilo M. Mendez, Interpreter, Regional Trial Court, Cebu City. He is, however, qualified to retire instead under R.A. 1616, as amended, for having more than 36 years, of government service, subject further to the availability of funds and the usual clearance requirements.
