Gentlemen:

Quoted hereunder, for your information, is a resolution of the Court En Banc dated JAN 19, 1999.

A.M. No. 97-7-229-RTC. (Re: Inhibition of Judge Conrado O. Lupos in Spl. Proceeding No. 459 and Civil Cases Nos. 458 and 106.)

Acting on the Order dated 7 October 1998 of Judge-Designate Ricardo B. Lapesura, Regional Trial Court, Branch 5, Oras, Eastern Samar, inhibiting himself from taking further cognizance of Civil Case No. 458 and Sp. Proc. No. 459 is related to him within the 6th degree of consaguinity, the Court Resolved to: (a) NOTE and AFFIRM the order of inhibition of Judge Ricardo B. Lapesura isued in Civil Case No. 458 and Special Proceeding No. 459 (b) DESIGNATE Judge Arnulfo O. Bugtas, Regional Trial Court, Branch 2, Borongan, Eastern Samar, to hear and decide Civil Case No. 458 and Special Proceeding No. 459 at Regional Trial Court, Branch 5, Oras, Eastern Samar, utilizing for the purpose the personnel of the latter court. Under this designation, Judge Bugtas shall not be entitled to additional compensation, except the payment of a travel expense allowance.
