Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 19, 1999.

A.M. No. 98-12-166-MTCC (Re: Petition for change of venue of Criminal Case No. 21527.)

Acting on the petition of private complainant/petitioner Erlinda Andales praying for change of venue of Criminal Case No. 21527, entitled "People of the Philippines vs. Effie Andales and Mila Barnuevo", for Concubinage from its present venue at the MTCC, Branch 3, Legaspi City to the Metropolitan Trial Court of Malabon, Metro Manila where petitioner is residing for the reason that she fears for her life and can not afford to frequent Legaspi City to attend to her case because she is in financial distress, the Comment dated April 21, 1998 interposing no objection thereto to the petition filed by Judge Noel Rubio and the Letter, dated 23 September 1998 of Judge Rubio informing the Court that he cannot secure the comments of the two (2) accused for they are still at large, the Court Resolved to: (a) DENY the petition for transfer of venue of Criminal Case No. 21527 to the Metropolitan Trial Court, Malabon, Metro Manila, and (b) DIRECT Judge Noel R. Rubio of Metropolitan Trial Court in Cities, Branch 3, Legazpi City, to proceed with the trial of the case at the present venue, with a further directive that he exercise the power of the court for the arrest of the accused if they have not been arrested up to now.
