Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 19, 1999.

A.M. No. 98-12-379-RTC (Re: Inhibition of Judge Jose Y. Aguirre, Jr. in Civil Case No. 531.)

Acting on the Order, dated 7 August 1998, of the Executive Judge Jose Y. Aguirre, Jr., Regional Trial Court, Branch 55, Himamaylan, Negros Occidental, inhibiting himself from hearing Civil Case No. 531, entitled "Zenaida Z. Rodriguez, et al. vs. Luz R. Zayco, et al.," to avoid suspicion of partiality considering that his orders dated 9 June 1997 and 27 August 1997 which were brought to the Court of Appeals by the plaintiffs were overturned by the appellate court in its decision dated 22 June 1998, the Court Resolved to: (a) NOTE the order of inhibition dated 7 August 1998 of Executive Judge Jose Y. Aguirre, Jr., Regional Trial Court, Branch 55, Himamaylan, Negros Occidental; (b) DESIGNATE Judge Edgardo L. delos Santos, Regional Trial Court, Branch 61, Kabankalan City, to hear and decide Civil Case No. 531, utilizing for the purpose the personnel of the former court. Judge delos Santos shall be entitled to per diems and reimbursement of travelling expenses.
