Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 26, 1999.
A.M. No. 98-12-387-RTC (Re: Query whether or not a detailed Judge can issue a valid order despite the assumption of the appointed Judge to the same court.)
Acting on the Letter-request, dated 28 September 1998, of Ms. Lilia A. Ulan, inquiring whether or not a detailed Judge can issue a valid order despite the assumption of the appointed presiding judge to the same court, and for the reasons stated therein, the Court Resolved to (a) DENY the request of Ms. Lilia A. Ulan, that the order dated 23 September 1997, of Judge Hilario T. Corcuera be declared null and void, and Order Criminal Case SC No. 4226 before RTC, Branch 27, Sta. Cruz, Laguna to proceed with dispatch up to its conclusion.
