Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 19, 1999.
A.M. No. 98-12-393-RTC (Re: Inhibition of Judge Tomas C. Leynes in Criminal Case No. C-5478.)
Acting on the Order, dated 15 September 1998 of Judge Tomas C. Leynes, Regional Trial Court, Branch 40, Calapan City, inhibiting himself from hearing Criminal Case No. C-5478, entitled "People of the Philippines vs. Carlo Vernon Goco" to erase the impression that he is biased, considering that the accused is the son of the owner/administrator of a school where the judge is teaching law subjects and that they are neighbors, the Court Resolved to: (a) NOTE the order of inhibition of Judge Tomas C. Leynes, Regional Trial Court, Branch 40, Calapan City, Oriental Mindoro in Criminal Case No. C-5478 and (b) DESIGNATE Judge Normelito J. Ballocanag, Regional Trial Court, Branch 41, Pinamalayan, Oriental Mindoro, to hear and decide the above-entitled case at Branch 40, Calapan City (Oriental Mindoro), utilizing for the purpose the personnel of the latter court. Judge Ballocanag shall not be entitled to additional compensation except payment of per diems and reimbursement of travelling expenses.
