RE: INHIBITION OF ACTING JUDGE RODOLFO A. ESCOVILLA IN CRIM. CASE NO. 240(95)

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 19, 1999.

A.M. No. 98-8-243-RTC (Re: Inhibition of Acting Judge Rodolfo A. Escovilla in Criminal Case No. 240(95).)

Acting on the Letter, dated 12 October 1998, of Judge Paul T. Arcangel, Regional Trial Court, Branch 12, Davao City, stating in its pertinent portion the following: "That after an investigation conducted by the undersigned, he found that accused Rolando Rarama in Criminal Case No. 240 (95) was his Process Server when he was the Presiding Judge of the then City court of Davao City, Branch 5 from 1975 to 1983, and in view of the foregoing, and for reasons of propriety, the undersigned most respectfully prays for this Honorable Court to relieve him from trying Criminal Case No. 240 (95) entitled "People of the Philippines vs. Rolando Rarama," the Court Resolved to: (1) NOTE the letter dated 12 October 1998, filed by Judge Paul T. Arcangel Regional Trial Court, Branch 12, Davao City; (2) MODIFY the resolution issued 1 September 1998 to: (a) RELIEVE Judge Arcangel of his designation to try, hear and decide Criminal Case No. 240 (95), entitled "People of he Philippines vs. Rolando Rarama, et al.," for Violation of R.A. 3019; and (b) DESIGNATE Judge Gregorio A. Palabrica, Regional Trial Court, Branch 34, Panabo, Davao del Norte, to try, hear and decide said criminal case utilizing for said purpose the court room and court personnel of the Regional Trial Court, Branch 18, Digos, Davao del Sur. Judge Palabrica shall only be entitled to per diems and reimbursement of travelling expenses.
