Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUL 21, 1999.

G.R. No. 129427 (Rizaldi Mendoza vs. Sec. of Labor.)

It has been brought to the attention of the Court that the resolution of 15 February 1999 requiring private respondents anew to file their comment on the petition for certiorari (not a mention to dismiss), addressed to petitioner Rizaldi Mendoza and private respondents Arnold Pabillore, Fortunato Jimenez, JR., and Romeo A. Tiongson c/o Pilipinas Shell Petroleum Corporation, Pandacan 1011 Manila, was returned unserved with notation "RTS unclaimed."

It appears that since petitioner Rizaldi Mendoza and private respondents are employees of Pilipinas Shell Petroleum Corporation, the copy of the resolution of 15 February 1999 was sent to them through their employer Pilipinas Shell Petroleum Corporation. Petitioner Rizaldi Mendoza is assisted by Lagman Mangali and Associates Law Offices, while private respondents are not represented by counsel. Consequently, the resolution of 15 February 1999 sent to petitioner Rizaldi Mendoza should have been sent to his counsel.

Consequently, the Court RESOLVES to REQUIRE personal service of the aforesaid resolution on private respondents Arnold Pabillore, Fortunato Jimenez, Jr., and Romeo A. Tiongson at Pilipinas Shell Petroleum Corporation, Pandacan 1011 Manila, and on Lagman Mangali and Associates, counsel for petitioner Rizaldi Mendoza. There appears to be no need to send notice to petitioner Mendoza himself as he is represented by counsel.
